GENERAL TERMS AND CONDITIONS

Rayne Care AG, Lyrenweg 8, 8047 Zurich, Switzerland (“rayne care”, “we”), operates the online shop at raynecare.com.

These General Terms and Conditions (“Terms”) apply to orders placed through our online shop. Mandatory statutory provisions applicable to specific products or countries may apply in addition.

We may amend these Terms with effect for future orders. The version in force at the time the order is placed shall apply.

By completing an order, you accept these Terms. Mandatory statutory consumer rights, in particular those applicable in the country in which the consumer has their habitual residence, remain unaffected.

1 CONCLUSION OF THE CONTRACT

Contracting party: For rayne care products, your contracting party is Rayne Care AG, Lyrenweg 8, 8047 Zurich, Switzerland. For partner products, the relevant product page will identify the contracting party.

Order: The display of products in the online shop does not constitute a binding offer. By clicking the button confirming an order subject to payment, you submit a binding order.

Order confirmation: After receiving your order, we will send you an electronic confirmation. Unless otherwise stated during checkout, the contract is concluded when we send our express order confirmation.

Business days: Where these Terms refer to business days, this means Monday to Friday, excluding statutory public holidays at the relevant place of performance.

Correction of input errors: Before you submit your order, all your details are shown in an overview. You can correct input errors at any time there, using the editing functions in the shopping cart and checkout, or using your browser’s back button.

Contract languages: The contract can be concluded in German, English and French.

Storage of the contract text: We store the contract text. You will receive the order details with the order confirmation by e-mail. You can access, save and print these Terms at any time at raynecare.com.

2 PRICES AND COSTS

Prices: The prices shown in the online shop at the time of the order apply. For consumers, applicable taxes and charges are displayed in accordance with statutory requirements.

Shipping costs: Any shipping charges and any other costs known before conclusion of the contract will be displayed before the order is completed. Where free shipping is offered for certain order values or delivery countries, the conditions displayed in the online shop apply.

Price changes: We may change prices at any time for future orders. An order already placed remains subject to the price displayed at the time of the order.

Due date: The purchase price and any applicable shipping costs are due upon conclusion of the contract unless otherwise stated for the selected payment method.

VAT and import charges: Prices include the VAT applicable in the respective delivery country. Deliveries within Switzerland are shipped from Switzerland, and deliveries within the European Union from our warehouse in Germany; no customs duties or import charges apply to these deliveries. For deliveries to other countries, customs duties, import taxes and customs clearance fees may apply. You will be informed of this before completing your order; these charges are borne by the customer.

3 PAYMENTS

Payment methods: The payment methods displayed during checkout are available. Individual payment methods may be restricted depending on the delivery country, order value or technical availability.

Payment processing: Payments may be processed by external payment service providers, whose additional terms may apply to their services.

Credit card payments: Credit cards are charged in accordance with the conditions displayed during checkout and/or the conditions of the payment service provider.

Any additional payment fees charged by rayne care, if applicable, will be transparently disclosed before the order is completed.

4 DELIVERY

Delivery address: We deliver to the delivery address specified in the order and to the countries offered in our online shop.

Delivery and safe-place instructions: Delivery without personal handover will only take place where permitted under the relevant carrier's terms or where expressly requested by you. Mandatory statutory rules governing the transfer of risk in consumer contracts remain unaffected.

Partial deliveries: Reasonable partial deliveries are permitted. If a partial delivery is made at our initiative, we bear any additional shipping costs caused by it.

Delivery times: Unless expressly stated to be binding, stated delivery times are estimates. Mandatory statutory rights in the event of delayed delivery remain unaffected.

5 WARRANTY AND DEFECTS

5.1 Inspection of goods and notification of defects

Please inspect the delivered items after receipt and inform us of any apparent defects or incorrect deliveries as soon as possible at hello@raynecare.com, stating your order number and, where possible, including a short description and photos.

Late notification does not restrict the mandatory statutory warranty and conformity rights of consumers. Nor does the use or opening of a hygiene product exclude these rights.

5.2 Warranty for defective products

In the case of defective or non-conforming products, claims are governed by the applicable statutory warranty and conformity provisions. For sales to consumers in the European Union, we are liable for any lack of conformity that becomes apparent within two years of delivery, subject to more extensive mandatory national rights.

In accordance with applicable law, consumers may require the goods to be brought into conformity free of charge by replacement or repair, unless this is impossible or disproportionate. For the rayne Disc, for hygiene reasons, the remedy is generally provided by replacement. If such a remedy is not possible, not successful or not sufficient under mandatory law, the customer is entitled to the further statutory rights, in particular a price reduction or termination of the contract with a refund of the purchase price.

5.3 Mandatory consumer rights

Mandatory statutory warranty, conformity and consumer rights remain unaffected in all cases. In particular, the respective mandatory statutory warranty and conformity provisions apply to consumers habitually resident in the European Union.

The voluntary guarantees or return rights provided for in these Terms, in particular the 90-day money-back guarantee under Section 6.3, apply in addition to these statutory rights and do not restrict them.

6 RETURNS, RIGHT OF WITHDRAWAL AND VOLUNTARY MONEY-BACK GUARANTEE

6.1 Statutory right of withdrawal

Consumers who are entitled under applicable law to a statutory right of withdrawal for distance contracts – in particular consumers in the European Union – may generally withdraw from the contract within 14 days of receipt of the goods without giving any reason. The statutory provisions apply. Details on the conditions, exercise and consequences of withdrawal, as well as the model withdrawal form, can be found in our separate Withdrawal Policy at https://raynecare.com/en/pages/right-of-withdrawal

Statutory rights of withdrawal are not restricted by our voluntary 90-day money-back guarantee (Section 6.3).

6.2 Exception from the statutory right of withdrawal for sealed hygiene products

Where provided by applicable law, the statutory right of withdrawal does not apply or expires in respect of sealed goods that are not suitable for return for reasons of health protection or hygiene once their seal has been removed after delivery.

This applies in particular to rayne Discs where a seal intended to protect hygiene has been opened or removed after receipt.

This exception applies only to the statutory right of withdrawal. Statutory warranty and conformity rights for defective or non-conforming products remain unaffected. The voluntary money-back guarantee under Section 6.3 also applies to opened rayne Discs.

6.3 Voluntary 90-day money-back guarantee for the rayne Disc

Guarantee: Independently of statutory rights of withdrawal, warranty and conformity, Rayne Care AG, Lyrenweg 8, 8047 Zurich, Switzerland, as guarantor, grants a voluntary 90-day money-back guarantee for the rayne Disc. The guarantee applies exclusively to rayne Discs purchased directly through our online shop at raynecare.com.

Guarantee period: The guarantee applies for 90 days from receipt of the goods. It is intended to allow you to try the rayne Disc for at least two menstrual cycles.

Conditions and procedure: The rayne Disc must have been used in accordance with the instructions for use. To make a claim, please send a message stating your order number to hello@raynecare.com within the 90-day period. After our confirmation, please return the rayne Disc to us in accordance with the return instructions provided to you.

Refund: We refund the purchase price actually paid for the rayne Disc, generally via the original payment method. Original shipping costs, express shipping costs, return shipping costs and any import charges are not refunded unless mandatory law provides otherwise. Fees charged on your side by banks or payment service providers in connection with the refund are not covered by rayne care.

Purchases from partners: For purchases made through retail, trade or distribution partners, the return and refund policies of the respective seller apply.

Relationship to statutory rights: The voluntary 90-day money-back guarantee does not restrict statutory rights, in particular statutory rights of withdrawal, warranty and conformity. In the event of a lack of conformity, you are entitled to the statutory remedies free of charge; these are not affected by the guarantee.

7 VOUCHERS

Redemption: Vouchers may be redeemed in accordance with the conditions stated on the voucher and/or in the online shop. Unless otherwise stated, vouchers cannot be used to purchase other vouchers and cannot be redeemed for cash.

Remaining balance: Any remaining balance remains available in accordance with the applicable voucher conditions. No interest is paid. If the balance is insufficient, the difference may be paid using a payment method offered at checkout.

Combination: Whether vouchers may be combined with promotions or discount codes is governed by the applicable promotion conditions.

Mandatory statutory rights, in particular regarding validity and reimbursement, remain unaffected.

8 DATA PROTECTION AND COOKIES

We process personal data in accordance with applicable data protection law, in particular Swiss data protection law and, where applicable, the General Data Protection Regulation (GDPR).

Details regarding the categories and purposes of processing, legal bases, recipients, retention and data-subject rights are set out in our Privacy Policy at https://raynecare.com/en/policies/privacy-policy.

EU data protection representative: As Rayne Care AG is established in Switzerland and offers goods to individuals in the European Union, it has appointed DataRep as its data protection representative in the EU pursuant to Article 27 GDPR. Individuals in the European Economic Area (EEA) may contact DataRep, in addition to rayne care’s own contact channels, on all matters relating to the processing of their personal data and the exercise of their rights – online via www.datarep.com/data-request or by post to the DataRep address in the relevant country, as set out in our Privacy Policy. Please state that your request relates to Rayne Care AG.

Cookies and similar technologies, in particular analytics and marketing technologies, are additionally governed by the information and choices provided through our cookie/consent banner. Where consent is legally required, the relevant non-essential technologies are only used after consent has been given. Consent may be withdrawn or adjusted using the options provided in the cookie/consent tool.

9 GOVERNING LAW AND JURISDICTION

Substantive Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence, where such provisions apply under the relevant rules of private international law.

Consumers benefit from the courts and jurisdictions provided by applicable law. No exclusive jurisdiction clause is imposed to the detriment of consumers.

For contracts with businesses, merchants or other persons acting outside their capacity as consumers, Zurich, Switzerland, is agreed as the place of jurisdiction to the extent legally permitted.

10 OUT-OF-COURT DISPUTE RESOLUTION / CONSUMER MEDIATION

If you have any questions or complaints, please contact us first at hello@raynecare.com. We aim to resolve all concerns promptly and amicably.

rayne care is not obliged to participate in dispute resolution proceedings before a consumer arbitration or mediation body and does not currently participate in such proceedings.

The former EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is therefore no longer linked.

The right of consumers to bring proceedings before the competent courts remains unaffected.

11 PACKAGING, DISPOSAL AND EXTENDED PRODUCER RESPONSIBILITY (EPR)

Producer responsibility: rayne care complies with the extended producer responsibility (“EPR”) obligations applicable in the respective delivery countries, in particular for packaging. For this purpose, Rayne Care AG has appointed an authorised EPR representative who handles the required registrations, reporting and participation in take-back and disposal schemes in the relevant countries.

Germany: For Germany, Rayne Care AG has appointed Green Dot Rep GmbH, Edmund-Rumpler-Strasse 7, 51149 Cologne, Germany, as its authorised representative pursuant to Section 35 of the German Packaging Act (VerpackG). We are registered in the LUCID packaging register of the Stiftung Zentrale Stelle Verpackungsregister under registration number DE5323643856505. Our packaging subject to system participation is licensed with the dual system “Der Grüne Punkt” in accordance with Section 7(1) VerpackG.

France: Our unique identification number (identifiant unique, IDU) for packaging is: [insert IDU].

Disposal: Please dispose of packaging in accordance with the sorting and disposal instructions on the packaging and/or on our website and the rules applicable where you live. The rayne Disc is a reusable product; information on disposal at the end of its useful life can be found in the instructions for use.

12 LIABILITY

Principle: The liability of rayne care is governed by the statutory provisions, unless otherwise provided below.

Unlimited liability: In particular, liability for damage caused intentionally or through gross negligence and mandatory statutory liability claims, in particular for injury to life, body or health and under applicable product liability provisions, remain unaffected.

Slight negligence: To the extent permitted by law, the liability of rayne care and its employees, legal representatives and vicarious agents for damage caused by slight negligence is excluded. This does not apply to breaches of essential contractual obligations, i.e. obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment you may regularly rely; in such cases, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

Indirect damage: In cases of slight negligence, rayne care is liable for indirect damage, consequential damage or loss of profit only to the extent that such liability cannot be excluded or limited under mandatory law.

Mandatory statutory consumer rights and the statutory warranty and conformity rights under Section 5 remain unaffected.

13 PRODUCT SAFETY AND USE

Important safety and usage information: Before using the rayne Disc for the first time, please read the instructions for use carefully and follow them. The instructions for use and the information on the packaging of the product delivered to you are authoritative. Use the rayne Disc only during menstruation. Wash your hands before insertion and removal and clean the disc before each reuse.

Wear time: Max. 12 hours. Also follow any local recommendations regarding maximum wear time for internal menstrual products.

Special information for France: In France, stricter rules apply in line with local recommendations: do not wear the rayne Disc for more than 6 hours; remove, empty and clean it after 6 hours at the latest. For the night, an external menstrual product is recommended. If you have previously had TSS, do not use internal menstrual products.

Toxic shock syndrome (TSS): Toxic Shock Syndrome (TSS) is rare but potentially life-threatening. Remove the disc immediately and seek medical attention if you experience sudden fever (>39°C), vomiting, diarrhoea, rash, sore throat, dizziness or fainting. These symptoms may not appear at the same time. If you have previously had TSS, seek medical advice before use.

Not a contraceptive: The rayne Disc is not a contraceptive and does not protect against pregnancy or sexually transmitted infections (STIs). Discontinue use in case of pain, irritation or unusual symptoms.

No medical advice: The information in our online shop, our content and our customer service is for general information only and does not replace medical advice. If you have health questions, please consult your doctor.

Product safety: Information about the manufacturer and, where required by law, the responsible person in the European Union can be found on the packaging and on the relevant product page.

14 FINAL PROVISIONS

Language versions: These Terms are available in German, English and French. In the event of any discrepancy between the language versions, the version in the language in which the contract was concluded shall prevail.

Force majeure: We are not liable for delays or non-performance of our obligations to the extent that these are caused by events beyond our control (e.g. natural events, pandemics, strikes, official measures or disruptions at transport or payment service providers), for as long as and to the extent that such events continue. Mandatory statutory rights, in particular in the event of late delivery and to a refund of payments already made, remain unaffected.

Severability: Should individual provisions of these Terms be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the statutory provisions.
